1. Acceptance of Terms

By accessing or using FinCubed (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time, and continued use after changes constitutes acceptance of the updated terms.

2. Eligibility

The Service is intended for use by individuals who are at least 18 years old and by businesses operating in Pakistan. By using the Service, you represent and warrant that you meet these requirements and have the legal capacity to enter into these terms.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and account credentials.
  • Promptly update your account information if it changes.
  • Accept responsibility for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your credentials.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Interfere with, disrupt, or overload the Service or its infrastructure.
  • Transmit malware, viruses, or any other harmful code.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools (bots, scrapers) to access the Service without our written consent.
  • Impersonate another person or misrepresent your affiliation with any entity.

5. Your Data

You retain ownership of all data you input into the Service. By using the Service, you grant us a limited, non-exclusive license to process, store, and display your data solely for the purpose of providing the Service to you.

You are responsible for the accuracy and legality of the data you input. The Service does not constitute professional accounting, tax, or legal advice. You should consult qualified professionals for such matters.

6. Payment and Subscription

Certain features of the Service may require a paid subscription. By selecting a paid plan:

  • You agree to pay all applicable fees as described at the time of purchase.
  • Payments are non-refundable except as required by applicable law.
  • We reserve the right to change pricing with reasonable advance notice.

The Service may integrate with or link to third-party services. We are not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party services is governed by their own terms and policies.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for any loss of data, revenue, or business resulting from use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, FinCubed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability.

Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FinCubed, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of your use of the Service or violation of these terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Governing Law

These terms are governed by and construed in accordance with the laws of Pakistan. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Islamabad, Pakistan.

14. Changes to These Terms

We reserve the right to update these terms at any time. Material changes will be notified through the Service or by email. Your continued use after changes take effect constitutes acceptance of the revised terms.
